2. Scope of Application

These General Terms and Conditions apply to all orders placed in the online shop at www.chillneck.shop by consumers within the meaning of § 13 BGB (German Civil Code). Deviating conditions do not apply. The contract language is German. In the case of differing translations, only the German version shall apply.

3. Conclusion of Contract

The presentation of the products does not constitute a legally binding offer. By submitting the order, you place a binding purchase offer. The contract is concluded as soon as we confirm dispatch or dispatch the goods. We reserve the right to cancel orders in the event of obvious pricing errors.

4. Prices and Payment

All prices are in Euro and include statutory value-added tax. Shipping costs depend on the delivery country (see § 5).

Payment options: PayPal, credit card, SEPA direct debit, Apple Pay, Google Pay, and Klarna (Sofort, invoice, installment purchase).

Invoices are provided exclusively digitally via email. There is no entitlement to specific payment methods.

5. Delivery & Shipping Costs

Delivery is carried out by DHL (Germany) or Correos (Spain). Delivery time is usually 1–2 weeks from dispatch confirmation.

Shipping to Germany and Spain is free. Shipping to Austria costs a flat €3.50; from an order value of €46 (equal to the Duo Pack), shipping to Austria is free too. Deliveries are currently made to Germany, Spain and Austria, later to other countries.

In case of refusal of acceptance or incorrect delivery address, return costs may be charged to the customer.

6. Retention of Title

The delivered goods remain our property until full payment has been made.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. All information regarding this – including the return address, deadlines, and a sample form – can be found under Right of Withdrawal. The customer bears the costs of the return.

8. Defects & Damaged Goods

Please check your order immediately upon receipt. In case of visible defects or transport damage, contact us within 3 days with a short description and meaningful photos at brrr@chillneck.shop.

9. Safety Instructions & Liability

Our products are intended exclusively for external use in the neck area. Use is at the user's own risk. The product must be checked for visible damage before every use; ChillNeck must not be used further if damage, cracks, leaks, or material changes are detectable.

• The product must not be opened, cut into, punctured, consumed, or otherwise altered or used for any purpose other than intended.
• Not suitable for children under 3 years – choking and suffocation hazard. When not in use, keep out of reach of children and pets.
• Do not heat, boil, microwave, or expose to flames, sharp objects, or temperatures outside the recommended range.
• Once it has gone soft (PCM liquid), do not expose it to prolonged direct sun or intense heat, as the material can leak out in this case. Instead, place it somewhere cooler or recharge it. Should the product be damaged and PCM leak out, use must be stopped immediately; direct contact with eyes, mouth, and open wounds must be avoided, and the product must not be used further.
• ChillNeck is not a medical device and does not replace medical treatment. It is not intended for the diagnosis, treatment, or prevention of any disease.

We are liable without limitation for damages arising from injury to life, body or health, and for damages based on intent or gross negligence. In the case of simple negligence, we are liable only for the breach of an essential contractual obligation (cardinal obligation) and limited in amount to the foreseeable damage typical for this type of contract. Liability under the Product Liability Act and under an expressly assumed guarantee remains unaffected. Any further liability is excluded.

ChillNeck is intended exclusively for proper, external use on the neck. We assume no liability for damages demonstrably caused by improper use, failure to observe the usage instructions (e.g. bending or squeezing while soft, exposure to high heat) or misuse, to the extent the damage is based on this.

ChillNeck is an everyday consumer item. Despite careful quality control, damage caused by improper use, external influences, aging, sharp objects, or unusual strain cannot be entirely ruled out. To the extent permitted by law, we accept no liability for consequential damage, in particular to clothing, bags, furniture, electronic devices, or other items, arising from damaged or improperly used goods. We recommend not using the product together with particularly delicate or valuable textiles or items where damage to the product cannot be ruled out.

10. Warranty

The statutory warranty rights apply. There is no further guarantee.

Warranty claims do not apply to damage resulting from improper use, improper storage or transport, unauthorized alterations to the product, or failure to observe the usage instructions.

Color variations, minor dimensional deviations, and production-related differences do not constitute a defect, provided the function of the product is not impaired as a result.

11. Customer Account & Newsletter

The creation of a customer account is voluntary. The newsletter is only sent after explicit consent using the double opt-in procedure. Unsubscription is possible at any time via the unsubscribe link in every email.

12. Data Protection & Cookies

We process personal data exclusively within the framework of applicable data protection laws. All information can be found in our Privacy Policy and our Cookie Policy. For analysis and optimization, we use, among others, Shopify Analytics, Meta-Pixel, and TikTok-Pixel. Consent to cookie usage is obtained via our cookie banner.

13. Applicable Law & Jurisdiction

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Mainz, as far as legally permissible.

14. Alternative Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
